After a jury trial, Robert T. Simon and Brad M. Simon of The Simon Law Group, LLP; and Christopher E. Russell and Marc Lazarus of Russell and Lazarus, APC, obtained a special jury verdict of $735,546.24, for a rear-end automobile accident. Although liability was not at issue, defendant contended that plaintiff’s injuries were pre-existing, given her lengthy pre-accident medical history. Regardless, plaintiff prevailed in establishing a causal link between the accident and plaintiff’s injuries. Prior to trial, plaintiff had offered a 998 offer for $600,000.00, and Defendant responded with a 998 offer for $200,000.00. Plaintiff’s counsel collaboratively negotiated a post-trial settlement of $925,000.00 on March 31, 2014—a figure $189,453.76 more than their trial verdict, $325,000.00 more than their pre-trial 998 offer, and $725,000.00 more than defendant’s pre-trial 998 offer.
