Plaintiffs brought a claim for the wrongful death of their husband/father, who was riding his bicycle when he swerved in front of a car and was struck. Seconds later, a second vehicle struck the man, killing him. The claim was only against the second vehicle. Plaintiffs alleged the driver had ample time to see the wreckage and the injured man, and could have avoided the death. Defendants denied liability, and contested the accident was the decedent’s fault as well as the first vehicle. A Santa Cruz jury returned a verdict for the greiving family.
