On July 30, 2013, Robert T. Simon and Brad M. Simon of The Simon Law Group, LLP, reached a global settlement with all defendants in the above-referenced case with mediator Michael Moorhead of Judicate West. The lawsuit stemmed from a slip and fall incident in the steam room of a Bally Total Fitness in North Hollywood. Mr. Rivas-Hernandez alleged to have slipped on oils in the steam room that were negligently permitted by the Bally staff, breaking his leg and resulting in a lengthy hospital stay. The defendants’ offer gradually increased after the Simons beat their motions for summary judgment to attempt to enforce a waiver agreement.
