Our client was intoxicated when she fell out of a window at a friend’s apartment late at night. Due to retrograde amnesia, she did not recall the circumstances of the fall, other than landing below the building with multiple fractures. The Simon Law Group alleged the windows were unsafe, in that it took minimal pressure to open them and it was too low at the opening. Defendant argued this accident was all plaintiff’s fault, and the building had no prior issues with its windows on its historic façade. On August 24, 2016, a Los Angeles jury awarded the plaintiff her full damages of $3,528,561.63 and putting 80% fault on the management and owner of the apartment complex.
