FAQ

Common Questions From Displaced Clients.

What should I do if my California law firm has closed?
If your California personal injury firm has closed or is no longer able to represent you, your case doesn’t have to end there. You are entitled to your file and you have the right to choose new counsel. We can help you understand your options at no cost.
What happens to my case if my California law firm closes?
Your case continues. You are entitled to your complete case file and you may select any qualified California attorney to take over your representation. Deadlines do not pause, so move quickly.
Can Simon Law Group take over my case from a closed firm?
In many cases, yes. We review each transfer individually. We accept transferred cases in auto accidents, truck accidents, motorcycle accidents, pedestrian accidents, premises liability, product liability, and wrongful death. Some case types we don’t accept; we’ll tell you that directly and refer you to a firm that can help.
Will I have to start my case over if I switch attorneys?
No. Work product, filings, discovery, and existing court deadlines transfer with your case. Your new attorney picks up where the prior firm left off.
How much does it cost to transfer my case to Simon Law Group?
Nothing out of pocket. We work on contingency. You pay nothing unless we recover for you. The contingency fee split between the prior firm and the new firm is handled between the firms under California Rule of Professional Conduct 1.5.1.
How do I get my case file from my prior firm?
Under California Rule of Professional Conduct 1.16(e)(1), your prior firm (or the receiver, if one has been appointed) must release your case file on request. If you have trouble obtaining your file, call us and we’ll help you make the request in writing.
What if my case is close to trial or a major deadline?
Call us today. We move quickly on cases with active deadlines and we can substitute in as counsel of record on short notice if needed.
Can I switch lawyers while my case is already in litigation?
Yes. California clients have the right to change counsel at any stage of a case, including during active litigation. The new attorney files a substitution-of-attorney form with the court, and the case continues with the same docket and the same deadlines. If your case is in suit and you want to change firms, move quickly so the substitution is on file before the next hearing.
My attorney closed their practice mid-case. What do I do?
First, request your complete case file in writing (your prior firm or its receiver is required to release it under California Rule of Professional Conduct 1.16(e)(1)). Second, identify any upcoming court deadlines or hearings. Third, retain new counsel quickly. Simon Law Group can help with all three steps. Call us and we’ll walk you through the request letter and pull the court docket to confirm what’s pending.
How do I find a new personal injury attorney in California?
Look for a California-licensed personal injury firm with trial experience, a clean State Bar record, and direct attorney access (not a phone-tree intake mill). Read recent client reviews, check the firm’s case results, and ask whether the attorneys actually try cases or only settle. Simon Law Group offers free, no-pressure case reviews, and you can confirm our State Bar standing at calbar.ca.gov.
