Types of ICE and Immigration Enforcement Cases We Handle
We represent people who have been harmed by Immigration and Customs Enforcement or other federal immigration enforcement agents in situations such as:
- Excessive force – Unnecessary or disproportionate force during arrest, detention, or transport (e.g., beatings, Tasers, restraint injuries).
- ICE shootings – Unjustified or negligent use of firearms by ICE or CBP agents.
- Wrongful arrest or detention – Detaining U.S. citizens, lawful permanent residents, or others without proper basis; mistaken identity; or detention beyond lawful authority.
- Injury during arrest or detention – Physical injuries (broken bones, head trauma, internal injuries) caused by rough handling, neglect, or unsafe conditions.
- Failure to provide medical care – Denial or delay of necessary medical treatment while in ICE or CBP custody, leading to serious harm or death.
- Abuse in detention facilities – Assault, retaliation, or inhumane conditions that cause injury or worsen medical conditions.
Legal Pathways: How You Can Sue ICE or Federal Agents
Holding federal immigration agents accountable usually involves one or both of these legal frameworks:
Bivens Actions (Constitutional Claims)
A Bivens claim is a lawsuit against federal officials in their individual capacity for violating your constitutional rights, for example, excessive force (Fourth Amendment) or deliberate indifference to serious medical needs (Eighth Amendment). Recoveries can include compensation for medical bills, lost wages, pain and suffering, and in some cases punitive damages.
Note: Recent Supreme Court decisions (including Egbert v. Boule) have limited where Bivens is available. An experienced civil rights attorney can advise whether your facts support a Bivens claim and what alternatives exist.
Federal Tort Claims Act (FTCA)
The Federal Tort Claims Act allows you to sue the United States for certain torts committed by federal employees, including ICE and CBP agents, acting within the scope of their employment. You must first file an administrative claim with the responsible agency (e.g., ICE/CBP or DHS). If the agency denies the claim or does not respond within the statutory period, you may then file a lawsuit in federal court.
FTCA claims can cover negligence, assault and battery (in some circumstances), and wrongful death. There are strict deadlines and procedural rules, so it’s important to consult a lawyer as soon as possible.

Our Cases: Fighting for ICE Abuse Victims
The Simon Law Group and our Justice Team, including attorney Jason Sanchez, are actively representing families and individuals in high-profile ICE civil rights cases across Southern California. These cases show our commitment to holding federal immigration enforcement accountable.
Jaime Alanís Garcia (Ventura County, July 2025)
Jaime Alanís Garcia, a 57-year-old farmworker from Michoacán, Mexico, died on July 12, 2025, from catastrophic injuries sustained during an ICE raid at Glass House Farms in Camarillo. He fell approximately 30 feet from a greenhouse roof onto concrete during the chaotic July 10 raid, suffering a broken neck, fractured skull, and severed artery. He was the first known person to die during Trump administration immigration enforcement operations in Southern California and had worked at the farm for a decade, supporting his wife and daughter in Mexico. Our Justice Team filed a federal court claim demanding accountability for his death.
Francisco Longoria (San Bernardino, August 2025)
In August 2025, masked federal agents surrounded Francisco Longoria’s work truck in San Bernardino without identifying themselves, broke the vehicle’s windows, and fired shots when he drove away fearing for his safety and his passengers’. Two bullets narrowly missed his 18-year-old son. The Simon Law Group released surveillance and cellphone video that contradicts federal claims that Longoria struck officers. Our attorneys, including Jason Sanchez, have demanded an investigation and continue to fight for accountability.
Carlos Jimenez (Ontario, October 2025)
Carlos Jimenez, a 25-year-old U.S. citizen and father of three, was shot from behind by ICE agents in Ontario, California, on October 30, 2025. According to his lawyers, he had stopped to warn the agents that children would soon be gathering at a nearby school bus stop. After an agent threatened him with pepper spray and drew a gun, he attempted to drive away and was shot through his back passenger window in the shoulder. The Simon Law Group represents him and is pursuing legal action for medical bills, lost wages, and emotional trauma—arguing the shooting was not justified self-defense

Frequently Asked Questions: ICE Civil Rights and Enforcement Injuries
Yes. If an ICE or CBP agent used unreasonable or excessive force during your arrest, detention, or transport, you may have a claim under the Fourth Amendment (Bivens) and/or under the Federal Tort Claims Act. An ICE civil rights attorney can review the facts and advise you on the best path.
Yes. If you were wrongfully detained or arrested by ICE—for example, you are a U.S. citizen, were mistaken for someone else, or were held without proper legal basis—you may have a claim for false imprisonment or violation of your constitutional rights. Contact a lawyer who handles ICE wrongful arrest cases to discuss your options.
A Bivens lawsuit is a federal court action against individual federal officials (such as ICE agents) for violating your constitutional rights. It does not sue the agency itself. Recoveries can include compensation and sometimes punitive damages. Not every type of claim is still allowed under current law, so it’s important to get legal advice.
Under the FTCA, you first file an administrative claim with the responsible federal agency (e.g., ICE or CBP). If the agency denies the claim or fails to respond within the required time, you may file a lawsuit against the United States in federal court. There are strict time limits, so contacting an immigration enforcement injury lawyer early is important.
Yes. We represent individuals and families in cases where ICE or CBP agents used deadly force or caused serious injury through use of a firearm. If you or a loved one was shot or injured in an ICE-related shooting, we can discuss your options in a free consultation.
An attorney who has held a press conference on Capitol Hill, supported client testimony before Congress, and spoken publicly on ICE accountability understands both the legal landscape and the policy context. That experience can inform strategy, discovery, and the way your case is presented to achieve the best outcome for you.
We serve clients across the United States of America, including those harmed by ICE or CBP in connection with enforcement activity.
